Licensed casinos in states like Michigan, Pennsylvania, and New Jersey must undergo regular audits to prove their games aren’t rigged, and they must keep player funds separate from business money. In contrast, illegal online casinos have no audits, no oversight, and players cannot verify if games are fair. New York officials warned that these illegal casinos “can seriously ruin people’s finances” because there’s no guarantee the operator will pay winning bets.

Fraud is a huge problem with fake online casinos that trick people into giving up money and personal information. South Dakota’s gaming commission warned players in April 2025 about fraudulent casinos using misleading ads, fake apps, and cloned websites to steal money. Connecticut’s new Senate Bill 1235 specifically targets sweepstakes casinos because they “simulate gambling games but operate outside traditional gaming laws” without required protections. Licensed casinos must verify players are 21+, offer self-exclusion options for problem gamblers, and guarantee payouts within set timeframes. Unregulated sites skip all these protections.

The social costs of unregulated online gambling are serious, including problem gambling, financial devastation, and family breakdown. In the Philippines, lawmakers are pushing for either complete bans or stricter regulations on online gambling in 2025 because of these social harms. Studies show that easy access to online gambling without proper controls leads to higher rates of gambling addiction. Licensed casinos must offer help resources and limit betting amounts, but illegal sites have no such requirements.

Recent enforcement shows states are taking action aggressively. Illinois Gaming Board sent more than 60 cease-and-desist letters to illegal online casino operators between 2025 and early 2026. Montana signed Senate Bill 555 in 2025, making it a crime to promote gambling features digitally starting October 1, 2025. Indiana proposed House Bill 1052 in January 2026 to ban sweepstakes casinos, classifying violations as Level 6 felonies. These actions show growing pressure to shut down illegal operations.

Only seven states currently allow legal internet casino gaming: Michigan, Pennsylvania, New Jersey, West Virginia, Connecticut, Delaware, and Nevada. The other 43 states either ban online casinos entirely or haven’t legalized them yet. In states like South Dakota, all online casino games including slots, table games, and card games are explicitly banned by law. This means players in most states have no legal way to gamble online through casino sites.

The bottom line is that online casinos aren’t being banned because gambling itself is wrong—many states have legal casinos and allow gambling. Instead, bans target unlicensed, unregulated operations that exploit loopholes, endanger players, and skip taxes. States are closing sweepstakes casino loopholes and enforcing gambling laws to protect residents from fraud while keeping licensed, regulated gambling options available through proper venues.
